By accessing or using our Services in any manner, you agree to these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all users including browsers, registered users, and subscribers.

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use our Services.
• Users between 13–18 must have parental or guardian consent.
• These Terms supersede any prior agreements between you and MalaniSoftTech regarding the Services.

MalaniSoftTech provides mobile applications, games, web applications, and related digital products (collectively, "Services"). We reserve the right to:

• Modify, update, or discontinue any feature or Service at any time with or without prior notice
• Introduce premium features, subscriptions, or paid tiers at our discretion
• Perform scheduled or emergency maintenance that may temporarily interrupt access
• Add, remove, or change third-party integrations and partners

We do not guarantee that the Services will be available at all times, uninterrupted, or error-free.

3.1 Account Registration

• You may be required to create an account to access certain features of the Services
• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your login credentials
• You must notify us immediately at malanisofttech@gmail.com of any unauthorized use of your account

3.2 Account Responsibility

• You are solely responsible for all activity that occurs under your account
• You may not share your account credentials or allow others to access your account
• We are not liable for any loss arising from unauthorized account access due to your failure to keep credentials secure
• One person may not maintain more than one account (unless expressly permitted)

You agree to use the Services only for lawful purposes and in accordance with these Terms. The following conduct is strictly prohibited:

• Using the Services to violate any local, state, national, or international law or regulation
• Attempting to gain unauthorized access to any part of the Services, servers, or networks
• Modifying, reverse-engineering, decompiling, or disassembling any part of the Services
• Uploading or transmitting malicious code, viruses, or harmful data
• Collecting or harvesting user data from the Services without authorization
• Using automated tools, bots, scrapers, or scripts to interact with the Services
• Impersonating any person or entity, or misrepresenting your affiliation
• Posting or transmitting harassing, defamatory, obscene, or offensive content
• Circumventing any technological measures or content protection systems
• Engaging in cheating, exploiting bugs, or unfair play in any game Services

All content, materials, features, and functionality of the Services — including but not limited to software, code, text, graphics, logos, icons, audio clips, game assets, and data — are the exclusive property of Malani Jainil / MalaniSoftTech or its content suppliers and are protected by applicable intellectual property laws.

5.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal license to access and use the Services for your own personal, non-commercial purposes.

5.2 Restrictions

• You may not reproduce, distribute, modify, or create derivative works of any part of the Services
• You may not publicly display, perform, or transmit any content from the Services without prior written consent
• You may not remove or alter any copyright, trademark, or proprietary notices
• You may not use our trademarks, logos, or brand assets without express written permission

5.3 User-Generated Content

If the Services allow you to submit content (feedback, ratings, posts, etc.), you grant MalaniSoftTech a worldwide, royalty-free, irrevocable license to use, reproduce, modify, and display such content in connection with the Services. You represent that you own or have the right to submit such content.

• All prices are displayed in the applicable local currency and are inclusive of applicable taxes where required by law
• Virtual currency and in-app items have no real-world monetary value and cannot be exchanged or redeemed for cash
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• Refund requests must be submitted through the relevant app store platform
• We reserve the right to modify pricing at any time; changes will be communicated in advance

Our free Services are supported by advertising. By using free-tier Services, you acknowledge and agree to the following:

• Advertisements may be displayed within the Services, including banner ads, interstitials, rewarded videos, and native ads
• Personalized advertising requires your explicit opt-in consent, as required by GDPR, DPDP, and applicable ad platform policies (2026)
• You can opt out of personalized ads through your device privacy settings or in-app settings
• Non-personalized (contextual) ads may still appear even after opting out
• We are not responsible for the content, accuracy, or practices of third-party advertisers
• Upgrading to our premium Services removes all advertisements
• Ads shown comply with Google Play Ads Policy 2026, Apple App Store guidelines, and IAB standards

Your privacy is extremely important to us. Our collection, use, and handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

• By using the Services, you consent to the data practices described in our Privacy Policy
• We comply with the GDPR, CCPA/CPRA, India's DPDP Act 2023, and other applicable data protection laws
• You may exercise your data rights (access, correction, deletion, portability) at any time by contacting malanisofttech@gmail.com

MalaniSoftTech expressly disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Services will be uninterrupted, timely, secure, or error-free
• That any defects or errors in the Services will be corrected
• That the Services or servers are free of viruses or other harmful components
• The accuracy, reliability, or completeness of any information provided through the Services

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

This includes, without limitation, damages for:

• Loss of profits, revenue, data, goodwill, or other intangible losses
• Cost of substitute goods or services
• Unauthorized access to or alteration of your data
• Any bugs, viruses, or harmful code transmitted through the Services
• Interruption or cessation of the Services

Our total aggregate liability to you for any claim arising out of or related to these Terms or the Services shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) ₹500 / USD $10, whichever is applicable in your jurisdiction.

Some jurisdictions do not allow limitation of liability for certain types of damages, so some limitations above may not apply to you.

Either party may terminate this agreement at any time:

11.1 Termination by You

• You may stop using the Services at any time by uninstalling our applications and deleting your account
• To request account deletion and data erasure, contact malanisofttech@gmail.com

11.2 Termination by Us

• We may suspend or permanently terminate your access immediately, without notice, if you breach any provision of these Terms
• We may terminate accounts for prolonged inactivity (typically 24+ months without login)
• We may discontinue the Services entirely with reasonable advance notice

11.3 Effect of Termination

• Upon termination, your license to use the Services immediately ceases
• All virtual currency, items, and progress associated with your account will be forfeited
• Provisions of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, and limitation of liability

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Users in the EU/UK may also benefit from mandatory consumer protection laws in their jurisdiction of residence.

12.2 Dispute Resolution

• We encourage you to first contact us at malanisofttech@gmail.com to resolve disputes informally
• If a dispute cannot be resolved informally within 30 days, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India)
• The seat of arbitration shall be Gujarat, India; proceedings shall be in English
• Notwithstanding the foregoing, either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm

12.3 Class Action Waiver

To the extent permitted by applicable law, you waive the right to participate in class-action lawsuits or class-wide arbitrations against MalaniSoftTech.

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document
• Notify you via in-app notification, email, or a prominent notice on our website at least 15 days before the new Terms take effect
• Where required by law, seek renewed consent for significant changes

Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of the changes. If you disagree with the updated Terms, you must stop using the Services and may request account deletion.
